The judiciary ends the controversy over amending the Personal Status Law and refutes the media distortion and falsehood therein

Today, Sunday, the Incomparable Legal Chamber sponsored a meeting to review the amended draft correction for Individual Status Regulation No. ( 188) of 1959.

The media of the legal executive expressed in an assertion, “During the gathering, the articles of the previously mentioned draft regulation were evaluated, and it turned out to be obvious from it that the media proclamations that sum up the draft revision and depict it in a wrong way were mistaken, as its motivation is (wedding minors or denying the mother of kid guardianship or denying the spouse of support, and denying the little girl of acquiring land), while this depiction goes against reality and what this change holds back nothing, turns out to be certain that the premise of correcting the ongoing Individual Status Regulation depends at first on the message of Article (41) of the Constitution of the Republic of Iraq for the year 2005, which states ((Iraqis are allowed to comply to their own status as per their religions, convictions or decision, and this is managed by regulation)), so the issue connected with individual status is a decision for the individual, however as per a regulation gave by the Chamber of Delegates.”

He proceeded, “The first draft regulation proposed didn’t address the itemized arrangements connected with family matters, like marriage, separate, guardianship, support, and different issues connected with the legitimate and jurisprudential perspectives, yet rather alluded these subjects to the Code of Lawful Decisions, which will be arranged later by the Logical Chamber in the Shiite Enrichment Office and the Logical and Fatwa Board in the Sunni Gift Office in a joint effort with the Preeminent Legal Committee and submitted to the Place of Delegates for endorsement inside (6) six months from the date of the requirement of this regulation.”

The gathering was gone to by the Preeminent Legal Committee, VPs of the Court of Cassation, Kazem Abbas and Hassan Fouad, the Senior Adjudicator of the Individual Status and Matters Authority, Saleh Shamkhi, and the Head of Legal Oversight, Judge Laith Jabr, and from the Place of Agents, individuals from the Chamber, Dunya Abdul Jabbar Al-Shammari, Basem Naghamish Al-Gharibawi, Raed Hamdan Al-Maliki, Mohammed Jassim Al-Khafaji, Hussein Ali Al-Yassari, and Murtada Ali Al-Saadi.
